Item 8.01		Other Events.

On October 20, 2008, BPI Energy, Inc.’s legal counsel filed a motion for leave to withdraw as counsel in BPI’s litigation against affiliates of the Drummond Coal Co. in the United States District Court for the Southern District of Illinois. BPI plans to oppose the motion.
