Soultopia Faces Resistance from Local Farmers Market Association, Denied Access to Sell its Hemp Products in The Local Markets

As per the AB-45 Hemp Bill passed by California Governor Gavin Newsom on October 6, 2021, inclusion of hemp and cannabinoids (e.g., CBD), extracts, or derivatives of hemp in food and beverages, dietary supplements, cosmetics, and processed pet food provided that they, among other things, contain less than 0.3% THC was made legal. Soultopia is a company that manufactures water-soluble cannabinoids (CBDs) for our products and therefore we require regular access to raw hemp that can be processed into our products including cannabis beverages, and oils.

As a legally registered organization in Napa, CA, Soultopia was denied the right to sell our hemp products at the local farmers' markets. The company has already challenged the Napa farmers markets decision to deny our application, and we would like to throw light on the local farmers market blocking the community's access to our hemp products. Soultopia has procured all necessary permits and is already for sale at local retailers, and in spite of everything, Soultopia is still facing heavy resistance from the local farmers' market in Napa. Soultopia urges the local authorities and news organizations to shed light on California’s AB-45 Hemp Bill and the 2018 Hemp Farm Bill which makes hemp legal across the country, with the hope of bringing more access to consumers while educating them on the benefits of Hemp.

AB-45 Hemp bill defines the maximum inclusion of “THC and comparable cannabinoid”, and excludes from the definition of THC any THC isomer that does not cause intoxication. The law, however, does not provide any guidance on maximum serving sizes, active cannabinoid concentration per serving size, the number of servings per container, and similar requirements for foods and beverages, although it provides the Department with the authority to issue regulations on these issues.
