ITEM 8.01. OTHER EVENTS.
On August 1, 2006, Oscient Pharmaceuticals Corporation issued a press release announcing that FACTIVE(R) (gemifloxacin mesylate) tablets has been approved by the Ministry of Health in Mexico to be marketed as FACTIVE(R)-5 for the five-day treatment of community-acquired pneumonia, acute bacterial exacerbations of chronic bronchitis and acute bacterial sinusitis. Pfizer, S.A. de C.V. (Pfizer Mexico) sublicensed the rights to develop and commercialize FACTIVE in Mexico in February of this year. The press release is attached hereto as Exhibit 99.1.
